Proposed Changes to Wisconsin Food Code

The Wisconsin Department of Health Services (DHS) is proposing amendments to the Wisconsin Food Code (DHS Chapter 196 and Appendix), based on changes in the 2009 edition of the FDA Model Food Code.

The Wisconsin Restaurant Association (WRA) participated in the process that initially reviewed, debated and developed the proposed rules and supports the process of building consensus between industry and regulatory agencies. The Food Code, unlike many other regulations, is based on sound science and research. It is also built by debate and consensus building between industry and regulatory, along with academia and consumer groups. Most of the changes proposed are based on issues passed through the National Conference for Food Protection. A few are from rules put through the state legislature and/or Governor at the request of food manufacturers.

As part of the next phase in the proposal process, the DHS has asked WRA member restaurants and affected small businesses for comments and feedback on the drafted updates and revisions.

In order to protect consumers, restaurant owners and employees and the integrity of the industry, it is important that the we in the industry understand the need to keep up with properly vetted scientific principles. That sometimes means we need to make operational changes to be in compliance. Adoption of the proposed changes to the Wisconsin Food Code will bring state regulations current with national standards.

Prior to completing any updates, however, DHS is gathering economic-related commentary from Wisconsin’s foodservice community to ensure that updating the rule will not have significant effects on the economy, jobs or the overall competitiveness of the state. Comments on the proposal will be accepted until July 30, 2012.
